* Recognises Buni Caretaker Committee
A High Court sitting in Asaba Wednesday struck out a case instituted against the All Progressive Congress, (APC) Congress to elect party executives in Delta State.
The ward Congress was slated for July 31 , 2021.
The court presided by Hon Justice G.B Briki-Okolosi also stated the case of the plaintiff was an abuse of court process which ought not have been brought to the court at the first instance as it was a waste of the courts time
Aggrieved aspirants of the party during the wards Congress led by Chukwusa Matthew and 14 others in a suit No: A/139/ 2021, Between: Chukwusa Edafe Matthew & 14 Ors Vs. ApC & Ors which was filed to set aside APC Ward, LGA and State Congresses in Delta State.had approached the Court at the heels of the Ward Congress, which was widely reported as peaceful and acceptable in Delta State.
They equally tried to restrain Gov. Mai Mala Buni of Yobe State along with other members from acting or parading as the APC National Caretaker Committee until the determination of a substantive suit before the court.
In his brief ruling, Justice Briki-Okolosi while striking out the case, further averred that similar cases like that of the plaintiffs has been decided previously by courts of co-ordinate jurisdiction.
While saying that the matter is an internal affairs of the APC which the court will not dabble into and that the court is not a political arena which politicians tries to drag it into.
According to him, “the case of the plaintiffs is nonjusticeable and lacks merit. The action is non-justiciable and incurably incompetent. It was emphatically rechoed that the substratum of the matter bothers on the internal affairs of the party.”
Principal among the reliefs sought by the Claimants/Applicants and thrown away was “An order of interim injunction of this Honourable Court restraining the 2nd – 14th Defendants/Respondents from further acting or parading themselves as the members of the Caretaker/ Extraordinary Convention Planning Committee (CECPC) of the 1st Defendant pending the hearing and determination of the Motion on Notice already filed and served in the suit.
In a space of two (2) months, the Distractors of APC and their co-travellers have just been floored at the Delta State High Court of Justice, Asaba Judicial Division for the second time.
Commenting on the judgement, Francis Amaechi, Directorate of Media and Publicity, APC, Delta State recalled that on the 15th day of October, 2021, the High Court of Justice of Delta State, struck-out an action filed by Elvis Ayomanor ( listed as the pseudo Deputy State Chairman of APC) in Suit No: A/145/21, Between: Elvis Ayomanor & Ors Vs. APC & Ors challenging the APC Ward, LGA and State Congresses.
